Terms of Service

Scene Architect ("the Platform") is operated by DreamSmyth LLC ("we", "us", "our"). By creating an account or using this Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Age Requirement

You must be at least 18 years of age to use this Platform. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts of anyone we believe to be under 18.

2. Nature of Content

This Platform hosts user-generated descriptions of BDSM scenes, kink activities, and related content intended for consenting adults. All content on this Platform is fantasy, creative expression, or hypothetical scenario planning. The Platform does not facilitate, arrange, or endorse any real-world sexual activity.

DreamSmyth LLC is not responsible for any actions taken by users based on content found on this Platform. All real-world activities are undertaken at the sole risk and responsibility of the individuals involved.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You agree to provide accurate information during registration.

4. User Content & License

By submitting content to the Platform (including but not limited to scene descriptions, ratings, comments, profile information, and session playlists), you grant DreamSmyth LLC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your content in any media or format, for any purpose, including but not limited to improving the Platform, research, analytics, and commercial use.

You represent that you have the right to submit any content you post and that it does not infringe on the rights of any third party.

5. Prohibited Content

You may not post content that:

• Depicts, describes, or promotes sexual activity involving minors
• Contains personally identifiable information of others without their consent
• Constitutes harassment, threats, or doxxing of any individual
• Violates any applicable law

We reserve the right to remove any content and terminate any account at our sole discretion, with or without notice.

6. Disclaimer of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DREAMSMYTH LLC DISCLAIMS ALL LIABILITY FOR:

• Any injury, harm, damage, or loss resulting from activities described on the Platform
• Any interactions between users, whether online or offline
• The accuracy, safety, or feasibility of any scene description or safety note posted by users
• Any emotional, physical, or psychological harm arising from the use of this Platform
• Any unauthorized access to or alteration of your data

You use this Platform entirely at your own risk. You acknowledge that BDSM activities carry inherent risks and that the Platform is not a substitute for proper education, training, communication, and consent between all parties involved in any real-world activity.

7. Indemnification

You agree to indemnify, defend, and hold harmless DreamSmyth LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

8. Privacy

We collect the following information:

• Account information: username, email address, and optional profile details (FetLife name, social media usernames, location, bio)
• Usage data: IP addresses, browser information, and activity on the Platform
• Content you submit: scene descriptions, votes, comments, and session data

We use this information to operate and improve the Platform, prevent abuse, and for analytics. We do not sell your personal information to third parties. We may share aggregated, anonymized data for research or commercial purposes.

You may request deletion of your account by contacting us. Note that content you have submitted may be retained in anonymized form per the license granted in Section 4.

9. Modifications

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, United States. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
